Escape to Extraordinary Rental Agreement


Thank you for choosing Escape to Extraordinary as your Vacation Rental Provider! We want you to have a wonderful experience here in Hawaii. Please let us know if there is anything, we can assist you with while you are here.


Check-In and Check-Out Times: Check in time is 3:00 PM on the day of arrival. Check out time is 11:00 AM on the day of departure. Late check-out or additional days may be arranged, subject to availability plus payment of additional fees.

Reservation Deposit: Your reservation will be held by your deposit, which is due at the time of the booking and is equal to twenty-five percent (25%) of the total booking amount. The balance is due sixty (60) days prior to your arrival date. All amounts are to be paid in US funds. We gladly accept Visa, MasterCard, American Express, and Discover credit cards as well as personal or business checks, certified checks, and money orders.

Cancellations: Cancellations made sixty (60) days or more prior to arrival with written notice shall be given a full refund minus a $100.00 cancellation fee. Cancellations made less than sixty (60) days prior to arrival shall forfeit the entire rent plus the applicable Hawaii tax on the rent. The security deposit and cleaning fee shall be returned. There is no refund for early departures or no shows. We are sorry, but there are no exceptions to this rule for the protection of our owners. We strongly recommend that you purchase travel insurance to protect your investment in case of unforeseen circumstances that may arise.

Book With Confidence: Should travel to Hawaii be restricted for any reason (such as COVID-19), you may either rebook a different date with no penalty or cancel at any time and receive a full refund minus the 3.5% cancellation fee to cover our expenses of credit card and booking fees that we have paid on your behalf.

Security Deposit: All guests are required to pay a refundable security deposit which is then held as security against damage, theft, or other charges to the unit incurred by the guests. The security deposit less any deductions incurred will be refunded to you within 14 days of your departure from the property. Security deposits made via credit card shall be refunded to the same credit card.

Cleaning Fee: All guests will pay a non-refundable post cleaning fee. This will cover the cleaning needed to prepare the unit for the next guest. Please refer to the attached Departure Guidelines in order to avoid additional cleaning charges, which will be billed at $35.00 per hour. If unit is not left in suitable condition, guest understands that agent reserves the right to charge guest for any repairs or special cleaning and a copy of the invoice will be provided to the guest.

Payment by Check: If payment of rent is made by check that is dishonored by the bank for any reason, the guest agrees to pay $50.00 for each dishonored check up to the maximum allowed by state law, and subsequent rent payments shall be made in a guaranteed form of payment.

Directions and Keys: Upon receipt of full payment, you will receive our Rental Receipt and Directions letter as well as the link to provide your guest information. This will provide driving directions from the Keahole (Kona) Airport to your vacation property along with the location and the code for the lockbox containing the key to the front door. Please be sure to bring these instructions with you for reference.

Supplies: Supplies provided for our guests include dishes and eating utensils, automatic dishwasher, bath, and hand soap, toilet paper, paper towels, and laundry detergent. Enough for your length of stay is typically provided unless your group has excessive needs. You can purchase additional items from nearby stores as needed.

Insurance: Guests’ personal property and vehicles are not insured by Escape to Extraordinary, LLC. Neither Escape to Extraordinary, LLC nor the owner shall be responsible for any loss or theft of guest's personal belongings either inside or outside of the unit.

Damage: The guest will maintain the premises, furnishings and appliances in clean and good condition and will surrender the same upon termination of the Agreement in as good a condition as when received. Should any problems arise within the unit during occupancy, the guest shall contact our office immediately and we will arrange for needed repairs. The guest understands that the guest is responsible for repair of any damage due to improper use, accidental destruction, or deliberate vandalism.

Keys, Remote Controls: Keys to the premises are the exclusive property of Escape to Extraordinary, LLC. There will be a minimum charge of $50.00 for replacement of each lost key and a $150.00 charge per item for lost garage or gate remote controls, pool keys, or gate access keys.

Phone and Fax Charges: All long-distance phone calls should be put on a credit or calling card. Any toll calls not charged will be assessed a $25 collection fee in addition to the actual charges.

Pets: No pets, dogs, cats, birds, or any other animals are allowed on or about the premises except for certified guide, service or signal dogs pursuant to state law.

Restrictions: Smoking is NOT permitted in any of our units or on the lanais. If anyone is found smoking or there is any evidence of such, the Security Deposit shall be automatically forfeited. Guests are not to store bicycles, scuba and diving gear, inflatable rafts or water toys inside the unit. These items can be stored in the garage, if available, or in one’s car. Towels and other gear are not to be draped over the railings or visible from any other properties in the complex.

Failure Indemnification: Escape to Extraordinary, LLC will not be liable for any damages or injury to the guest or any other person or to any property occurring on the premises or any part or in common areas. The guest agrees to hold Escape to Extraordinary, LLC harmless from any claims for damages, regardless of how caused. The subject property may have located thereon a swimming pool, hot tub spa, or have oceanfront access. A swimming pool is inherently dangerous, especially to young children and the infirm. The following are prohibited: diving and scuba diving in the pool, running in the pool area, glass containers in the pool area or on the lava beds, or any minor in or around the pool or the ocean without adult supervision. In consideration of the owner’s agreement to rent the subject property to the guest, the guest agrees to strictly abide by the Pool Rules, use a standard of caution around the ocean, and does further agree to indemnify and hold harmless the owner and Escape to Extraordinary, LLC from and against all claims, liability or loss that guest may sustain from the use or operation of the swimming pool, Jacuzzi, and the ocean by the guest and/or guest’s invitees. Guests understand that the natural world can be dangerous, rocks are slippery, and the ocean is dangerously unpredictable. Use at your own risk.

Entry and Inspection: Escape to Extraordinary, LLC will have the right to enter the premises pursuant to state law: (1) In case of emergency, without prior notice. (2) To make necessary repairs, alterations, improvements, supply necessary or agreed services, exhibit the premises to prospective or actual purchasers, mortgagees, workmen, insurance agents, or contractors, with 24-hour prior notice to the guest.

Use: The premises are to be used exclusively for residential purposes. No retail or other commercial use of premises is permitted. The premises are not to be used for meetings, receptions, or for parties. In the event a party is reported, the Agent has the prerogative to terminate this agreement and to ask disruptive Guests to vacate the premises without refund.

Conduct: The guest will not violate any Association, City, State, or Federal Laws in or about the premises. Use of premises shall not be such as to disturb or offend neighbors or residents. All house rules of the complex and resort must be followed. There is no smoking allowed in any of our Vacation Rentals. Escape to Extraordinary, LLC reserves the right to immediately terminate the tenancy if the guest violates any part of this agreement and shall automatically retain the security deposit in addition to previously paid funds.

Termination of Tenancy: Upon departure the guest will: (1) completely vacate the premises and any parking or storage areas used by the guest, (2) leave guest keys in the unit and lockbox key in the lockbox (3) leave remote controls, garage door openers, gate keys, and pools keys inside the unit on the kitchen counter, (4) leave all furnishings in the same condition and placement as received.

Governing Law: This agreement will be governed by the laws of the State of Hawaii.

Entire Agreement: the parties acknowledge that this Agreement expresses their entire understanding and agreement, and that there have been no warranties, representations, covenants or understandings made by either party to the other except such as are expressly set forth in this Agreement.

Compliance with Law: Both parties agree to comply with all applicable federal state, and local laws and regulations in performing their duties.

Severability: If any provision of the Agreement is found invalid or unenforceable pursuant to judicial decree or decision, the remainder will remain valid and enforceable according to its terms.

ACCEPTANCE

By completing and submitting this form, you indicate that you have carefully reviewed this rental agreement and agree to and accept its terms and conditions, and subject yourselves to all the promises and covenants therein contained. Your First and Last Names serve as a substitute for your signature.

Check-Out Guidelines…

To assist us in providing a healthy and safe environment for our cleaners as they prepare for future guests, we ask that you follow the checkout guidelines below:

  • Wash all excess towels and linens. There should be only one towel for each guest plus the bed linens from each bed on the bed left to be washed by the cleaners. Please do not make the beds before you leave.
  • Load the dishwasher and start before you leave.
  • Return everything you have moved to its original position.
  • Collect and carry all your rubbish, bottles, and cans to the trash containers outside.
  • Please make sure all garbage is tied up in the large plastic trash bags provided.
  • Remove ALL items from the refrigerator including condiments. Exceptions may be made for items that are unopened and unused.
  • Remove or dispose of ALL snorkel gear and beach toys. We cannot assure that these items are sanitary for future guests.
  • Check all the closets, drawers, and under the beds for any misplaced articles.
  • Turn off appliances, fans, and Air Conditioning, shut windows, and lock the doors
  • Housekeeping will charge a fee of $35.00 per hour for excess cleaning and $15.00 per load for excess laundry.
